Federal Judge Vacates H1-B Visa Fees
A federal judge struck down the Trump administration’s $100,000 fee on H1-B visa applications for skilled foreign workers, finding that it represented an unlawful tax, not a monetary penalty authorized by federal immigration laws. As the president lacks power to impose taxes, the court vacated the fee as unlawful.
The lawsuit was brought by 20 state attorneys general. Other challenges to the policy are pending, and the federal government has stated its intent to appeal the ruling.
